This is a smoke free property. Convenient location, near midtown Tucson. Casita B (850sf) is part of a 15 unit apartment complex where all units are situated around a pool. It has a fenced in yard for privacy and carefully chosen furnishings for your comfort and enjoyment. Both bedrooms have king size beds with linens and coordinated decor, the living room has leather furniture, a flat screen tv, and the kitchen is fully stocked with cooking and dining utensils. A washer and dryer are located in the casita as well. The property is centrally located to all of Tucson's tourist attractions, the University of Arizona and area hospitals. We do provide free secure parking in our gated parking lot for one car per casita. All parking is in assigned parking spaces. Traveling with a second vehicle, they are able to park on the street outside the complex, or if available we do have a few additional parking spaces for rent at $10 per night extra. Dogs up to 60 pounds allowed provided they are not a 'pit bull or pit bull mix', do not bark, and are not left in the unit alone unless crated. There is a limit of 2 dogs per unit. NO OTHER TYPES OF PETS ALLOWED. Please note: hosting a party, or group gathering such as a wedding, funeral, circus, baby showers, birthday parties, dinner parties etc are not allowed and will result in immediate eviction. Plan to have a couple of friends for family members over please just let us know. They will need to park on the street and you will need to escort them in. Pool: there is a large pool in the center of the property that is open 8 am to 8 pm and is for use by paying guests only. All kids 17 and under must be supervised by an adult-the adult must be in the pool area when their underaged guest/child is in the pool area. We do not heat the pool. Smoking is allowed in parking lot only, smoking is not allowed on other areas on this property. You will be asked to leave the property and forfeit the remaining portion of your payment if found to be smoking in the unit or refuse to smoke only in the parking lot. If smoking is noticed inside our rental, you will be charged for a thorough professional cleaning at a minimum of $250 to clean all bedding, furniture, walls, etc. Short Term Furnished. Rate posted is for Summer - April 1 to September 30 2026. Rates for fall and winter are higher-please ask. This Renter Agreement ("Agreement") is made and effective ("Agreement Date") between ("Owner and/or Manager") and ("Guest") regarding the property known as ("Rental Property") which is located at: This Agreement applies to the Guest's stay at Rental Property from ("Start Date") to ("End Date") but also applies to any other dates which may be included if the reservation is changed. This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest. In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions: Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. All reservations are considered transient in nature no matter the length of stay. Transient housing means the Guest can be immediately evicted if found to be in violation of any of the rules listed below. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the website or the confirmation letter, without prior approval by Owner. Guest is required to pay for additional guests above 2. The cost is an additional $30 per day per person over 2-this includes children. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification. In the event Guest wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable. A payment of firest month's rent and cleaning fee is taken by Owner at the time of the reservation. Additional monthly payments are due 7 days before start of next 30 day period-payment is automatic on credit card of Guest. If not paid by this time this Agreement will be cancelled and Guest must vacate on last day of paid reservation. All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction; all other refunds will be made within 30 days by check. A security deposit is required ("Security Deposit") and will be automatically reserved for the reservation. The automatic reserve is conducted by putting a hold or charge on the Guest's credit card for the amount of $500. The credit card of the last successful payment will be used. If there are no successful credit card payments, it is the responsibility of the Guest to pay in cashto the Owner to satisfy the Security Deposit requirement or provide another credit card. If, at the end of the rental period, the rental property is returned undamaged beyond normal wear and tear, the Security Deposit will be released in full within 3 days. In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and deductions made from the Security Deposit. Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within 2 business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, trash removal fees, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees. Owner is under no obligation to use the least expensive means of restoration. Regular payments and security deposits for the booking will be displayed as Desert Moon Vacation Rentals on the Guest's credit card statement. Rental period shall begin at ("Start Date" at 4 pm and end at ("End Date") at 11 am. No early check-ins or late check-outs are allowed without prior consent of Owner. ANIMALS: Guests must obtain permission from the Owner to have pets on the Rental Property. If permission is not given by the Owner, any pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid. The Owner allows dogs only (see exception for certain breeds listed below), up to 60 pounds in weight with a maximum of 2 per unit that have been pre-approved. Any other type of pet/animal is not allowed and subject to expedited eviction, forfeiture of all monies paid, and fine of $250 for each disallowed pet-animal. Pit bulls and Rottweilers are never allowed. In all cases-Guests must pickup the waste of their dogs daily and dispose of properly (do not flush down toilet) and walk dog on leash when in shared areas of the property. Failure to pickup after dog will result in $50 clean up fee. Animals are not allowed on furniture, in beds, or to be left in unit unless in crate. Guest must monitor dogs left in rear/side private fenced yards at all times animal is outside. Do not leave sliding glass dog open for dog to walk in and out of house. Guest has been notified that there are cameras on the property. All cameras are on the exterior of the structures and all for real time viewing and recording 24 hours a day 7 days a week of the property. Recordings are owned by Owners and for their use only. No refunds will be provided due to inoperable appliances, internet, cable TV or pool, etc. The Owner will make every reasonable effort to assure that such appliance/services will be and remain in good working order. No refunds will be given due to power/service blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god, nature, or human kind. Parking Lot: Parking is limited to 1 vehicle per unit in the secure parking lot. Parking spaces are assigned. Guest will be provided with the parking space number to be used for the duration of rental period. Parking in a space other than the one assigned may result in your vehicle being towed. towing and storage fees are the responsibility of the Guest. Any vehicle parked in secure parking lot that is there without permission is subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. The Owner will not provide notice that a vehicle has been towed. There are 2 handicapped parking spaces in the secure parking lot. If you have a handicapped sticker/plate for your vehicle please let us know so we can assign you a handicapped space provided they are available. An additional parking space may be available. The cost is $50 per month for one additional parking space (porvided one is available). No more than one additional space is allowed per unit. Oversized vehicles-those 20 feet or longer, and trailers are not allowed to be parked in the secure parking lot and must be parked on the street. Parking on the street is free. Visitors, deliveries, taxi, Lyft and Uber vehicles shall be met by Guest outside on the public street and shall not be allowed access to the secure parking lot. Guests are prohited (not allowed) to work on vehicles in the parking lot. Guests are prohibited from washing their vehicle in the parking lot. Washing a vehicle will result in a $50 fee added to the rental cost for each occurance. Theft/Loss: The Owners are not responsible for guests losses during their stay. Please lock and secure the unit and your vehicle at all times-this includes when you are at the pool. The Owners have made every effort to secure the property but that only works if you do your part. Do not give out your 5-digit number to anyone other than the paying guests that are staying with you, and do not leave a door or window unlocked (this includes your vehicle) except when you are in it. The pedestrian egress (exit) is through the entrance vehicle gate with your access code. The keypad is on the left side (west). Have a vistor or delivery you need to meet them at the entrance gate and use your code to open. Do NOT give out your code. A 5-digit number will be assigned to the Guest a minimum of 72-hours before check-in. This 5-digit number will allow you access to the vehicle entry gate and your unit. Do NOT give out this 5-digit number to anyone other than the people staying in your unit. Guests found in violation will have their reservation terminated and face immediate eviction. We take security very seriously. DELIVERIES: Do not have mail sent to the property-it will be returned. Do not have packages delivered to the property-they will be refused. If you need to receive mail or packages please use a drop locations such as The UPS Store or an Amazon Locker. If you order food/groceries to be delivered you must meet the driver outside the complex. AT NO TIME SHOULD YOU PROVIDE YOUR 5-DIGIT NUMBER FOR THE DRIVER TO ENTER THROUGH A GATE. POOL: A pool is provided at the Rental Property, it is tested for proper and safe chemicals as required by Pima County Health Services. Hours of operation are 8 am to 8 pm daily. The pool is NOT heated and therefore, is used seasonally. The typical season is May through October. Only paying guests are allowed access to the pool area and pool. Under no circumstances are pets, alcoholic drinks, or glass allowed in pool or in the fenced pool area. Misuse of the pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass, fecal matter, or throw-up will result in a Service Call Charge of $500 to be billed to the Guest that has caused the damage. Plastic cups have been provided in the unit-use these if bringing a beverage to the pool area. All persons under the age of 18 must be supervised by an adult over the age of 18. That adult must remain in the fenced pool area while the underaged person is in the pool or fenced pool area. No yelling, loud music, or horse play will be tolerated. NO PERSONS WEARING A DIAPER (EVEN IF A POOL DIAPER) IS ALLOWED IN THE POOL-PERIOD! Do not hold open the gate-it must be allowed to latch closed between guest access. Guest may move the furniture within the fenced pool area around but do not remove from fenced area nor place in pool itself. Beach towels for the pool have been provided in the unit (brightly colored oversized towels in linen closet) -please use these at the pool. Violations of these provisions shall be grounds for expedited eviction and forfeiture of all monies paid. HOUSEKEEPING: there is no daily housekeeping service. Housekeeping service is available. Please contact us for rates. Linens or towels, dishes, glasses, silverware, cooking utensil, pots, pans, small appliances etc are supplied with Rental Property, Guest is responsible for lost or damaged items. A full accounting will be provided to the Guest with 48 hours after checking out. Typical costs: Bath towel: $30, Hand towel: $20, Wash cloth: $15, Bath mat: $15, Kitchen towel: $15. Pillow: $20, blanket: $75, bed spread $100, mattress pad $100, mattress $500, fitted sheet $40, flat sheet $35, pillow cases $15 each. If pots and pans are damaged or cannot be cleaned you will incur a replacement charge-this will be itemized. Please ask for clarification if there is a concern. Water and Sewer: The property is on public water and public sewer. The mineral content in the water is high. Sewer pipes will clog up if improper material is flushed. No feminine products, diapers, paper towels, or wipes should be flushed at anytime. Please throw out all debris in trash when possible and do not 'feed' the garbage disposal food waste-throw what you can away. You are responsible for having the garbage disposal cleared of excessive food waste if it does become clogged. Please notify us with you have a plumbing fixture that is leaking water or if the toilet runs so we can fix. If it is found that feminine products or other items have been flushed and clog the pipes, you will be charged to have a plumber come out and snake the lines- cost is $300 minimum. FURNITURE: No interior furniture is to be moved outdoors. Outdoor furniture must remain within the confines of the property. Please return all furniture to where you found it when you arrived at the end of your rental period. If Owners or reps need to move the furniture back to its original location you will be charged $60 minimum. Wireless internet and cable TV: the property is provided with wireless internet for use of "paying" Guests only. Do not give password to visitors. Owners do not guarantee 'band width' or upload load/download speeds. Many of the units have smart TVs the Owners do not advertise them as smart TVs and do not guarantee the ability to stream videos on TVs. The Owners provide basic cable provided by COX. If it is found that the Guest is operating a business at the unit or over the internet the Guest will be asked to quit failure to do so shall result in the termination of guest occupancy with no refund of any kind WATER-We live in the desert so water use should be kept to a minimum. We do not allow you to wash your cars in the parking lot. Upon Checkout: Excessive cleaning due to excessive soiling of the premises will be charged at the rate of $50/hour per cleaner to clean. Normal use will not incur this extra fee. It is expected that it will take the cleaning crew of 2 no longer than 1-1/2 hours to clean the unit and return it to the condition it was in when the Guest first arrived. Guests will be charged if cleaning takes longer as the unit was left excessively dirty. Excessive dirtiness could include oven cleaning, picking up litter found on premises, burned or hard-dried food on cooking utensils, scrubbing food/stains off of upholstery, countertops, marks on walls/windows/doors, and/or floors. It is expected that all dishes and pots and pans are washed, dried, and returned to their shelves/cabinets-if cleaners are required to wash (or rewash because they were put away dirty) the Guest will incur additional fees. Excessively stained towels, linens, blankets, pillows will incur a replacement charge. Stains include those that will not come clean after laundering with bleach or oxyclean, hot water and laundry soap. FOUND ITEMS: Guest is responsible for all packing and shipping costs, including a $35 fee for Owner taking package to a shipping company, for any Found items that Owner is requested to return to Guest. Items found and not claimed within 2 days will be disposed of at the discretion of Owner. It is the Guest responsibility to contact the Owner if they believe they left items in the unit. In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the pool, gas grills, furniture, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner. Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. The Guest fully understands and acknowledges that life has inherent risks, dangers and hazards. Participation may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons. NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following: I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and floors can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity. I am over the age of 18 and assume complete responsibility for those in my charge under the age of 18 and any animals I bring on to the property. I hereby assume all legal and financial responsibility for bodily injury to me or to any person or animal on the property as a result of my actions. I will abide by the rules and accept these rental conditions: The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period. I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not. I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented. I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children, pets, and myself in my charge. All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
