LEASE AGREEMENT The Landlord hereby rents to the Resident, and the Resident rents from the Landlord, the premise dwelling unit known as: 511 W 6th Street Freeport, TX for a term of 12 months for a monthly rate of $2,200. Tenant is required to pay the full first month's rent before possession of the dwelling unit is granted to Resident by Landlord. Any pro-rated discount will be applied to the following month's rental sum. All rents are due on the first of each calendar month during which time the Resident has the dwelling unit and for the entire term of the agreement, payable at the above address. Total of all monthly fees, including rent, to be paid on the 1st of each calendar month in the amount of: Rent: $2,200 Pet Rent: $100 Total Monthly Payment: $2,300 1.3 RENT AND CHARGES DEPOSIT of $2,200 is required prior to moving in. PET DEPOSIT of $500 is required prior to moving in. LATE FEE will occur after the 4th day of the month. The fee assessed will be $55 for the 5th day and thereafter $10 per day until paid. Eviction notice will be in effect after the 12th day of the month. Should Resident's monthly payment also include additional monthly charges for utilities or appliances, non-payment of these charges may also result in late fees and/or eviction. Utility charges are subject to change at any time due to the usage charges. Landlord agrees to provide Resident proper notice of any said change. RESPONSIBILITIES Landlord's Responsibilities: The Landlord is responsible for all major repairs, including A/C, heating, cooling, and plumbing systems, except where plumbing issues are caused by the flushing of non-flushable items such as feminine products, paper towels, or other inappropriate materials. Resident's Responsibilities: The Resident is responsible for groundkeeping and all utility bills. Tenant negligence, including damage or repairs caused by misuse or neglect, is not covered by the Landlord. Pet Damages: Any damages caused by pets are the sole responsibility of the Resident. HOUSE RULES No Smoking Policy: Smoking is strictly prohibited inside the dwelling unit. Any evidence of smoking within the home will result in charges for cleaning, deodorizing, or damages caused. LEASE EXPIRATION AND TERMINATION 5. If no attempt by either party is made to renew or cancel this lease, it will auto-renew upon expiration of the current lease term. This lease shall automatically renew for an additional term of one year with a minimum 5% rent increase on the same terms and conditions as stated herein, save any changes made pursuant to law, until terminated. 6. Resident may terminate this agreement on the last day of any month by giving ninety (90) days prior written notice from the first day of the month, to the end of the month of move out, provided that the Resident has fulfilled the lease term. If Resident stays past the last day of the month of move out, Resident agrees that one full month's rent is due and payable and will be prorated upon move out. The Resident and any Co-Signer of this Lease will remain responsible for rent during the initial and successive terms of this Agreement and during any holdover period. Resident shall deliver peaceful possession of the premises to Landlord upon termination hereof for any reason. 7. After a minimum residency of 90 days, Resident may terminate this agreement on the last day of any month by giving ninety (90) days prior notice in writing upon the following conditions: 1. The death of any resident named above, OR 2. The payment of both a cancellation charge equal to TWO MONTHS RENT and full final month's rent. All three months' rent must be paid at the time notice is given, or notice will not be accepted, and Resident may be subject to eviction and/or collections. Cancellation charge is solely dedicated to the cancellation of this lease and is not to be used as rent during the notice period. Resident understands that the deposit is forfeited when the lease is terminated prior to the lease end date.
