Property Maintenance, Operations, and Tenant Responsibilities
Property Maintenance and Lawn Care
Tenant agrees to maintain the property in good, clean, and safe condition throughout the duration of the lease. Tenant is responsible for routine maintenance and upkeep of the property, including but not limited to lawn care, landscaping maintenance, and general exterior upkeep. Lawn care must be performed regularly and no less than once per month at a minimum, or more frequently as necessary to maintain the property in acceptable condition.
Pool Maintenance
Tenant shall ensure the swimming pool is maintained in clean, sanitary, and safe operating condition throughout the tenancy. Pool service must be performed on a regular basis by a licensed or professional pool service company. Tenant shall be responsible for all routine pool service costs, chemical balancing, maintaining proper water levels, and ensuring the filtration system operates properly. Tenant shall not allow the pool to become stagnant, unsanitary, or improperly maintained. Any damage to pool equipment, pumps, filters, or surfaces resulting from neglect or improper maintenance shall be the responsibility of the Tenant.
Pool Equipment Protection
Tenant shall ensure that all pool equipment including pumps, timers, heaters, and filtration systems remain operational and properly maintained. Tenant shall not alter or disable pool equipment. Any service or repair required as a result of neglect, misuse, or failure to maintain proper water chemistry shall be the responsibility of the Tenant.
Appliances Provided as Courtesy
The washer, dryer, refrigerator, oven, and dishwasher are supplied as a courtesy to the Tenant. Any and all costs associated with repair, maintenance, service, or replacement of these appliances during the tenancy shall be the sole responsibility of the Tenant. Landlord shall have no obligation to repair or replace these appliances.
HVAC Maintenance
Tenant agrees to properly maintain the heating and air conditioning system throughout the duration of the lease. Tenant shall replace HVAC air filters regularly and no less than once every thirty (30) days. Tenant shall not operate the HVAC system without a properly installed air filter. Any damage caused by failure to replace filters, misuse, neglect, or obstruction of vents shall be the responsibility of the Tenant. Tenant agrees to promptly notify Landlord of any malfunction or operational issue with the HVAC system.
HVAC Operation Requirement
Tenant shall maintain the HVAC system in operation at all times to ensure proper climate control and humidity management within the property. The thermostat shall not be set above 80 F for extended periods when the property is occupied or unoccupied. Tenant acknowledges that maintaining proper temperature and humidity levels is necessary to prevent mold, mildew, and structural damage to the property.
Humidity and Mold Prevention
Tenant agrees to maintain reasonable climate control within the property to prevent moisture accumulation and mold growth. The HVAC system must remain operational and set to maintain appropriate indoor humidity levels. Tenant shall not disable or shut off the HVAC system for extended periods, as doing so may result in excessive humidity, mold growth, and damage to the property. Any damage resulting from failure to maintain reasonable climate control shall be the responsibility of the Tenant.
Condensate Drain and Overflow Protection
Tenant shall ensure that the HVAC condensate drain line remains clear and unobstructed. Tenant shall promptly notify Landlord if water accumulation, leakage, or overflow is observed near the air handler, drain pan, or surrounding areas. Damage resulting from failure to report visible water leaks or drainage issues in a timely manner shall be the responsibility of the Tenant.
Pest Control
Tenant shall maintain the property in a clean and sanitary condition to prevent pest infestation. Tenant shall be responsible for routine pest control services during the tenancy, including treatment for insects, ants, roaches, fleas, and other common household pests that arise during occupancy.
Plumbing and Drain Care
Tenant shall properly use all plumbing fixtures and keep all drains free from obstruction. Tenant shall be responsible for service calls required to clear clogged drains caused by grease, food, hair, wipes, paper products other than toilet paper, feminine hygiene products, or other improper materials.
Freeze Protection
In the event temperatures approach freezing conditions, Tenant shall take reasonable precautions to protect plumbing and water lines from freezing or bursting. Such precautions include allowing exterior spigots and vulnerable water lines to drip slowly and ensuring adequate heat is maintained inside the property. Any damage resulting from failure to take reasonable freeze-prevention measures shall be the responsibility of the Tenant.
Extended Absence from Property
Tenant shall notify Landlord in writing if the property will be unoccupied for more than seven (7) consecutive days. During any extended absence, Tenant must ensure that the property remains secure and that the HVAC system remains operational to prevent humidity buildup, moisture damage, or mold growth. Tenant remains responsible for maintaining utilities and ensuring the property is protected from damage during any period of absence.
Utility Responsibility
Tenant shall maintain all required utility services for the property throughout the duration of the lease, including electricity and water. Utilities shall not be disconnected during the tenancy. Any damage to the property resulting from interruption of utilities shall be the responsibility of the Tenant.
Pets
Pets are permitted only with prior written approval from the Landlord. Tenant agrees to comply with all local laws and maintain control of all approved animals at all times. Exotic animals, livestock, horses, and wild or dangerous animals are strictly prohibited on the property.
Renters Insurance
Tenant shall maintain renters insurance throughout the entire term of the lease with a minimum liability coverage amount of $300,000. Tenant shall list the Landlord as an Additional Insured on the renters insurance policy and provide proof of coverage prior to move-in and upon request by the Landlord. Failure to obtain or maintain the required renters insurance coverage shall constitute a material violation of this lease agreement.
Rent and Late Fees
Rent is due in full on the first (1st) day of each month. If rent is not received by the third (3rd) day of the month, Tenant shall be assessed a late fee of $100.00 per day. Acceptance of a late payment does not waive the Landlord's right to enforce the terms of this lease or pursue any remedies available under Florida law for nonpayment of rent. Any returned or dishonored payment shall result in an additional returned payment fee as permitted by law. Continued failure to pay rent when due may result in termination of the lease and eviction proceedings as permitted under Florida law.
Tenant Negligence and Damage Responsibility
Tenant shall be responsible for any damage to the property, systems, appliances, fixtures, landscaping, pool equipment, plumbing, or structural components caused by Tenant negligence, misuse, abuse, or failure to properly maintain the property as required under this lease. Tenant agrees to promptly reimburse Landlord for the cost of repair or replacement of any such damage not resulting from normal wear and tear.
