Property Description, Use, and Lease Conditions
The Landlord hereby leases to the Tenant the residential property located at 209 Cortez Morrison Road, Lillington, North Carolina, together with the residential dwelling and the immediate yard area surrounding the home (the "Premises").
The property is located on acreage in a rural country setting, and Tenant acknowledges that this lease includes use of the house, driveway, and designated yard area only.
Exclusion of Barns and Outbuildings:
Any barns, storage buildings, sheds, equipment shelters, or other outbuildings located on the property are not included in this lease and are strictly prohibited from tenant use. Tenant shall not enter, store items in, park vehicles in, or otherwise utilize any barn, shed, or storage structure on the property unless written permission is provided by the Landlord. These structures remain under the sole possession and control of the Landlord.
Lease Term:
This lease shall be for a minimum term of twelve (12) months, beginning on the agreed start date and ending twelve (12) months thereafter unless otherwise agreed to in writing by both parties.
Renter's Insurance Requirement:
Tenant shall maintain active renter's insurance coverage for the entire duration of the lease. Proof of renter's insurance must be provided to the Landlord prior to move-in and must remain active throughout the lease term. Acceptable documentation may include a certificate of insurance or policy declaration page listing the Tenant as the insured party. Failure to maintain renter's insurance may be considered a violation of this lease.
Private Well Water:
The property is served by a private well water system, and tenants will not be billed separately for water usage. Tenant agrees to use the water responsibly and must notify the Landlord immediately of any leaks, plumbing problems, or water system issues.
Residential Use Only:
The Premises shall be used solely as a private residential dwelling by the Tenant(s) listed in the lease and may not be used for commercial or business activities without written permission from the Landlord.
No Farm Animals or Livestock:
Tenant shall not keep or raise farm animals or livestock on the property. This includes, but is not limited to, goats, chickens, ducks, pigs, cows, horses, sheep, or any other agricultural animals. Only approved household pets are permitted according to the pet policy outlined in this lease.
No Trailers, Campers, or Junk Vehicles:
Tenant shall not store or park travel trailers, camper trailers, RVs, motorhomes, boats, utility trailers used for storage, non-operational vehicles, unregistered vehicles, or junk vehicles on the property without written approval from the Landlord. The property may not be used for vehicle storage, mechanical work yards, or equipment storage.
Lawn and Property Maintenance:
Tenant is responsible for routine lawn and yard maintenance during the lease term, including mowing the grass, maintaining the general appearance of the yard, and removing trash or debris from the property. Tenant shall not remove trees, alter landscaping, or make structural changes to the property without written permission from the Landlord.
Rural Property Acknowledgement:
Tenant acknowledges that the property is located in a rural environment and that conditions typical of country living may exist, including wildlife, insects, agricultural activity in surrounding areas, gravel or dirt driveways, farm equipment nearby, and similar rural characteristics. These conditions are considered normal and shall not be deemed property defects.
Hold Harmless / Liability:
Tenant agrees that the Landlord shall not be held liable for injury, loss, or damage to persons or personal property occurring on the Premises, including but not limited to injuries caused by weather conditions, wildlife, insects, or natural terrain. Tenant agrees to hold harmless and indemnify the Landlord from any claims, damages, or legal actions arising from the Tenant's use of the property or the actions of Tenant's guests, invitees, or pets, except in cases of gross negligence by the Landlord.
Guest Stay Limit:
The Premises shall be occupied only by the Tenant(s) listed in this lease. Guests may stay on the property for no more than fourteen (14) consecutive days or twenty-one (21) total days within any twelve (12) month period unless written permission is granted by the Landlord. Any person residing on the property beyond these limits may be considered an unauthorized occupant and a violation of the lease.
Right of Entry and Inspection:
The Landlord or Landlord's authorized representatives may enter the Premises with reasonable notice, typically 24 hours, for purposes including property inspection, maintenance or repairs, or showing the property to prospective tenants or buyers. In the event of an emergency, the Landlord may enter the property without prior notice.
Failure to Pay Rent / Default:
If Tenant fails to pay rent when due, such failure shall constitute a default of this lease agreement. In the event of nonpayment of rent, the Landlord may issue a Ten-Day Demand for Possession for Nonpayment of Rent as permitted under North Carolina law. If the Tenant fails to pay the full amount owed within the time allowed by law, the Landlord may pursue summary ejectment (eviction) through the appropriate court. Tenant shall also be responsible for any court costs, filing fees, and other lawful expenses incurred by the Landlord as permitted by North Carolina law.
Pet Policy:
Pets are permitted only with prior written approval from the Landlord. A maximum of two (2) pets are allowed, and dogs must weigh 50 pounds or less. Tenant is responsible for any damage caused by pets, and an additional pet deposit or monthly pet fee may apply.
